KM files amicus brief in the 8th Cir. supporting SEC climate disclosure rules

KM partners Daniel Hume, Tom Elrod, and associate Lauren Wands have filed an amicus brief in the United States Court of Appeals for the Eighth Circuit in support of the SEC's recently introduced climate disclosure regulations. The rules would require many of the U.S.'s largest companies to disclosure their greenhouse gas emissions. They were adopted in March 2024, but their implementation put on hold pending the resolution of a consolidated Eighth Circuit case led by the Iowa Attorney General's Office challenging their legality.
KM filed its brief on behalf of a group of former SEC officials as well as scholars of law, finance and economics. The firm's brief was one of several filed with the court by consumer advocacy, environmental, investor, and academic groups arguing that the rules are both necessary and within the scope of the SEC's authority.
